Mahrang Baloch’s ECL Case: The Chief Justice IHC Loses His Cool at Lawyer

ISLAMABAD:  An unexpected confrontation occurred in the Islamabad High Court during the hearing of a petition seeking the removal of Mahrang Baloch’s name from the Exit Control List (ECL). The altercation took place between Chief Justice Sarfraz Dogar and Advocate Imaan Mazari, resulting in a sharp exchange of words.

The incident unfolded when Chief Justice Dogar made a pointed remark, stating, “If I pass any order in this case, Ms. Mazari will go down and host a programme, calling it a dictatorship.” The comment appeared to be directed at Imaan Mazari’s outspoken advocacy for her client and her political stance.

In her defence, Imaan Mazari clarified that her statements were made in her personal capacity and did not relate to her client’s case. “I have not made any comments outside the legal framework,” she stated. “What I said is my personal opinion and should not affect the case at hand.”

However, the Chief Justice responded with a reprimand, asserting that even lawyers must maintain decorum and respect within the courtroom. He further suggested, “Why not initiate contempt of court proceedings against you?”

Undeterred, Imaan Mazari fired back, asserting her constitutional right to freedom of expression. “I have not made any comments outside the law and the Constitution. If you wish to proceed with contempt of court, feel free to do so,” she said, adding, “The Constitution grants me the freedom of speech.”

As tensions escalated, the Chief Justice addressing Mazari’s husband said: “Hadi sahib, make her understand; if I get hold of her someday …” In turn, Mazari expressed her concerns, stating that if the court was threatening lawyers, it might be best to proceed with contempt of court proceedings.

Meanwhile, the Deputy Attorney General informed the court that in order to have Mahrang Baloch’s name removed from the ECL, the petitioner would first need to approach the Cabinet’s sub-committee for approval. The court then ordered that the necessary report be shared with the lawyers and adjourned the case for further proceedings.

This incident highlights the growing tensions surrounding the case and raises concerns about the conduct of judicial proceedings, as well as the delicate balance between legal rights and courtroom decorum.

The case is scheduled for further hearing on September 16, Mazari later posted on X (formerly Twitter).
